Resealing of Foreign Grants In Hong Kong
Under section 49 and Schedule 2 of the Probate and Administration Ordinance (Cap. 10), laws of Hong Kong (“PAO”), where a court of probate in the following countries or places has granted probate or letters of administration for a deceased’s estate, such probate or letters of administration may be sealed with the seal of the Hong Kong High Court (i.e. resealing of foreign grant in Hong Kong).
Such resealed probate or letters of administration shall be of the like force and effect, and the same operation in Hong Kong as if it was granted by the Hong Kong High Court.
The Hong Kong High Court may require and take into account evidence on the deceased’s domicile before making a decision on whether the foreign grant shall be resealed or not.
