Resealing of Singapore Grant in HK

When a Deceased died domiciled in Singapore and left assets in HK, and Grant of Probate / Letters of Administration has been issued by the Singapore High Court (Family Division), resealing application of the Singapore Grant may be made to the Probate Registry of the HK High Court.

Once resealed, the Singapore Grant shall have the same force and effect, and have the same operation in HK, as if it were granted by the HK Probate Registry. The executor named in the will or the administrator and co-administrator appointed under the Singapore Grant could then administer the Deceased’s assets in HK.

Some basic information required for our consideration include:

• Death Certificate of the Deceased
• Did the Deceased leave any will in HK ?
• Whether the executor/ administrator and co-administrator appointed under the Singapore Grant have the mental and physical capacity to deal with the resealing application in HK ?
• Information of the assets and liabilities of the Deceased in HK as at his date of death
• It is a contentious case ?

Signing of the HK resealing application documents:

If it is inconvenient for the applicant for the HK resealing application to come to HK for the signing of documents, the applicant can sign documents in the presence of a Notary Public in Singapore. We as HK lawyers will need to go through some Client Due Diligence procedures with the applicant for identity verification and AML purposes.

Rough estimate of time:

Depending on the circumstances of the case, it takes around 6-8 months or more for the HK Probate Registry to issue the Resealed Singapore Grant upon its approval.
